Justapedia: Digital Milennium Copyright Act (DMCA) Policy
 

Digital Millennium Copyright Act (DMCA) Policy falls under the Digital Millennium Copyright Act (17 U.S.C. § 512) ("DMCA") and as such, the Justapedia Foundation may be required to remove content from Justapedia in response to a valid DMCA takedown request. The DMCA provides a safe harbor, offering legal exemption from copyright infringement liability for online service providers like Justapedia. This immunity is vital to the free knowledge movement, supporting user freedoms that drive Justapedia's mission. To maintain safe harbor status, the Justapedia Foundation complies with valid DMCA takedown notices by removing potentially infringing content.

To uphold free speech and access to knowledge, the Justapedia Foundation critically evaluates DMCA takedown requests. If we believe the content in question is lawful (e.g., covered by fair use), we may push back against invalid requests. The DMCA requires that takedown notices be submitted by the copyright owner or their authorized agent, in good faith and under penalty of perjury.

If you are a copyright owner

If you believe your copyrighted work is being infringed on Justapedia, we encourage you to first seek resolution through our volunteer community in the spirit of open collaboration. You may contact the Justapedia volunteer community with an informal request for content removal. Please provide

  • The exact URL of the content, as shown in your web browser.

  • Sufficient evidence of your copyright ownership, such as a link to your published work, a scanned copy, or detailed publication information.

Alternatively, you may initiate a formal DMCA takedown process as outlined below and in our Terms of Use. Be aware that a third
party may file a counter-notice challenging your takedown request, prompting the Justapedia Foundation to restore the content unless you pursue legal action. Knowingly misrepresenting a claim may result in liability for damages, including costs and attorney fees. As the Justapedia Foundation cannot provide legal advice, you may wish to consult an attorney before filing a DMCA takedown notice.

The takedown notice must comply with 17 U.S.C. § 512(c)(3)(A) and include:

  • Your physical or electronic signature.

  • Your contact information (name, address, phone number, email).

  • Identification of the copyrighted work claimed to be infringed.

  • Identification of the allegedly infringing material, with enough detail (e.g., URL) to locate it on Justapedia.

  • A statement that you have a good faith belief the use is not authorized by the copyright owner, their agent, or the law.

  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

  • Consent to the jurisdiction of a United States federal court.
     

After submitting a DMCA Takedown Notice

Upon receiving a valid, statutorily compliant DMCA takedown notice, the Justapedia Foundation reviews the claim and removes the content if the infringement is substantiated. We will:

  • Post the takedown notice (with personal information redacted) on our website and share it with Lumen and other third parties, as appropriate, to promote transparency.

  • Notify the content uploader of the takedown and their right to file a counter-notice.

The content uploader may respond with a DMCA counter-notice. If a valid counter-notice is received, we notify the original complainant, who has 10 business days to file a lawsuit to prevent restoration of the content. If no legal action is taken, the Justapedia Foundation may restore the content within 10–14 business days, per 17 U.S.C. § 512(g)(2)(B)-(C). Counter-notices are also posted online in Category:DMCA Notices.
 

If you are a content uploader

If your content is removed due to a DMCA takedown notice, the Justapedia Foundation will make reasonable efforts to notify you. For transparency, we post takedown notices (with personal information redacted) on our website. Notices are available in Category:DMCA Notices.
 

If you believe your content was removed in error or misidentification (e.g., if it qualifies as fair use), you may file a DMCA counter-notice. Filing a counter-notice may lead to legal proceedings with the complainant to determine copyright ownership or legality of use. Knowingly misrepresenting your counter-notice may result in liability for damages, including costs and attorney fees. Consult an attorney before filing, as the Justapedia Foundation cannot provide legal advice.

A compliant DMCA counter-notice under 17 U.S.C. § 512(g)(3) must include:

  • Your physical or electronic signature.

  • Your name, address, and phone number.

  • Identification of the removed material and its location (e.g., URL) before removal.

  • A statement, under penalty of perjury, that the material was removed due to mistake or misidentification.

  • Consent to the jurisdiction of a federal court in the district where you reside (if in the U.S.) or where your service provider is located (if outside the U.S.).

  • Consent to accept service of process from the party who submitted the takedown notice.

 

After filing a DMCA Counter-Notice

Upon receiving a valid counter-notice, the Justapedia Foundation notifies the original complainant. The complainant has 10 business days to file a lawsuit to prevent content restoration. If no lawsuit is filed, we may restore the content within 10–14 business days, per 17 U.S.C. § 512(g)(2)(B)-(C). Counter-notices are posted online in Category:DMCA Notices.


Repeat copyright infringers

Per 17 U.S.C. § 512(i)(1)(A), the Justapedia Foundation maintains a policy to terminate, in appropriate circumstances, users or account holders who are repeat copyright infringers, ensuring compliance with DMCA safe harbor requirements.
